Volume LXI, Issue 4

The Federal Communications Commission (FCC) voted 2-to-1 this week to initiate a process to roll back regulations passed in a 2015 Open Internet Order that would have reclassified internet service providers (ISPs) as Title II common carriers.

The vote initiates a ninety-day Notice of Proposed Rulemaking (NPRM) comment period, and FCC Chairman Ajit Pai committed to make public any resulting order before voting on it.

US President Donald Trump this week signed the Cybersecurity Executive Order, Strengthening the Cybersecurity of Federal Networks and Critical Infrastructure, intended to increase efficiency and provide additional protections to government information technology (IT) systems.

The directive advances the administration’s efforts to modernize and secure federal networks that have been infiltrated by a variety of cyberattacks.

This week, the US Senate approved a resolution under the Congressional Review Act to roll-back the broadband consumer privacy rules adopted in October by the Federal Communications Commission (FCC), which would have gone into effect later this year.

The US House of Representatives approved a similar measure later in the week.

The broadband consumer privacy rules were intended to protect internet users from certain methods of unauthorized collection and utilization of sensitive data regarding their online activity.

Following up on last week’s report, the Trump administration confirmed this week that it will require federal agencies to abide by the National Institute of Standards and Technology (NIST) cybersecurity framework and, on a timely basis, report back on their implementation of its recommendations.

Trump’s larger priorities on cybersecurity include controlling and protecting federal networks and their data, safeguarding critical infrastructure, and securing the nation generally from cyber-threats; and his shorter term goals include curtailing botnets and fostering private sector participation in cyber-initiatives – regardless of politics.

The DCIA is encouraged by the updated draft of the Trump administration cybersecurity executive order now being reviewed by industry leaders, and we are hopeful that the order will be issued shortly.

The order is expected to hold federal managers accountable for vulnerabilities in their technology systems and require adoption of the series of cybersecurity best practices developed by the National Institute of Standards and Technology (NIST).

Congressman Ralph Abraham (R-LA) introduced the bill mandating that government agencies adopt the cybersecurity framework developed by the National Institute of Standards and Technology (NIST).
